OCFS may take any of the following actions, or any combination of actions, as part of the enforcement process:
Denial
“Renewal denied” means the application to renew the license or registration to operate the child day care program was denied, the license or registration was permitted to expire, and the enforcement action to deny the application of the program to renew the license or registration is final.
Revocation
“Revoked” means OCFS took action to rescind the license or registration to operate the child day care program. The enforcement action to revoke the license or registration is final, and the program may no longer operate.
Suspension
“Suspended” means the child day care program has been closed by OCFS because there is evidence that the public health or a child’s safety or welfare is in imminent danger. A program which has been suspended must immediately stop operating. Suspension will continue until OCFS has determined that the condition requiring suspension has been corrected, until the child day care license or registration has been revoked, or until the program successfully challenges OCFS’ decision to suspend.
Pending Status
Enforcement action is “pending” when a child day care program has been notified that OCFS is taking enforcement action. Enforcement action will remain “pending” until a final decision has been rendered by an administrative law judge or by a court, or until the enforcement action has been resolved. A program may continue to operate while an enforcement action is pending.
